1. Let the defect(s), if any, pointed out by the office be removed within four weeks from the date of this order, failing which the matter be listed again under the appropriate heading for necessary action.
2. Heard learned counsel for the petitioner and learned APP for the State.
3. Petitioner seeks regular bail in connection with Madhaurah P.S. Case No. 112 of 2022, dated 21.02.2022 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
4. The main submissions advanced by petitioner's counsel are that the FIR was registered against unknown persons and name of this petitioner surfaced in the alleged crime
Patna High Court CR. MISC. No.69398 of 2022(3) dt.25-04-2023 2/3 on the basis of confessional statement of co-accused Pintu Sharma @ Tinku Sharma but after petitioner's remand in the present matter no incriminating material or looted article was recovered either from the house the petitioner or his conscious possession and three co-accused persons Sahid Ajam, Meraj Ansari and Ajit Kumar Rawat @ Ajit KR. Rawat @ Ajit have been granted bail by different Benches of this Court vide orders passed in Cr. Misc. Nos. 64550 of 2022, 74146 of 2022 and 51595 of 2022 respectively and the name of co-accused Meraj Ansari and Ajit Kumar Rawat @ Ajit KR. Rawat @ Ajit, who are on bail, had also surfaced in the statement of co-accused Pintu Sharma @ Tinku Sharma and the petitioner has been languishing in jail since 23.03.2022. Further submission is that though against the petitioner there are criminal antecedents of seven cases but he was remanded in the said cases after having been remanded in the present matter.
5. Though, Learned APP appearing for the State has opposed the prayer for bail but has not pointed-out any incriminating evidence against the petitioner except the statement of co-accused Pintu Sharma @ Tinku Sharma.
6. Considering the above submissions and mainly the privilege of bail having been granted to the above-mentioned
Patna High Court CR. MISC. No.69398 of 2022(3) dt.25-04-2023 3/3 three co-accused persons whose case appears to be identical to the petitioner's case and in respect of the petitioner's involvement in the alleged crime prosecution has mainly placed reliance upon the statement of Pintu Sharma @ Tinku Sharma, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Madhaurah P.S. Case No. 112 of 2022.
