The petitioner seeks bail in connection with Sessions Case No. 169/14 arising out of Surajgarha P.S. Case No. 169/14 registered under sections 147, 148, 149, 341, 323, 452, 380, 302 and 506 of the Indian Penal Code.

The prosecution case in short is that the wife of the informant was killed by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.4.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. Though the

Patna High Court CR. MISC. No.66527 of 2019(4) dt.04-03-2020 2/2 informant claims himself to be eye witness to the said occurrence but the same is not acceptable. No specific overt act is alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. The informant is an eye witness. He has identified the petitioner in the electric light who had entered into the house and committed murder of the sister of the informant by way of strangulation.

Considering the nature of allegation, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to conclude the trial at the earliest. (Sudhir Singh, J) Pankaj/- U T
