1. Heard the parties.
2. The petitioner has renewed his prayer for regular bail in connection with Kudhani P.S. Case No. 418 of 2023 registered for the offence punishable under section 304(B) / 34 of the I.P.C. Earlier bail application of the petitioner was rejected on 09.08.2024 vide Cr. Misc. No. 52174 of 2024 on merit granting liberty to the petitioner to renew his prayer for regular bail after one year if the trial does not show any progress.
3. It is a case of dowry death. The petitioner is the husband of the deceased.
4. Learned counsel for the petitioner submits that charges have been framed on 15.10.2025 but no prosecution witness has been examined as yet. The petitioner is in custody since 13.05.2024 and the trial is not likely to be concluded in near future.

5. This court has called for a report regarding the stage of the trial vide order dated 10.10.2025 and in pursuance thereof learned District & Addl. Sessions Judge 20th Muzaffarpur has submitted his report vide letter no. 548 dated 31.10.2025 stating therein that charges have been framed against the petitioner (husband) on 15.10.2025. There are altogether seven charge sheet witnesses. Summons were issued against the witnesses on 16.10.2025 but till date no prosecution witness has been examined in this case.
6. Regard being had to the submissions made by the parties, taking into consideration the fact that this is second attempt for bail on behalf of the petitioner, who is in custody since 13.05.2024, accordingly, I am inclined to grant regular bail to the petitioner.
7. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000 /- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Kudhani P.S. Case No. 418 of 2023.
