JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Sultanganj P. S. Case No. 51 of 2019, disclosing offences under Sections 147, 148, 149, 323, 324, 307, 427 of the Indian Penal Code and Section 27 of the Arms Act. F.I.R. disclosed that petitioners and other accused persons came variously armed assaulted the informant and damaged his vehicle.

Submission of the learned counsel for the petitioners is that there is delay of one month in lodging the F.I.R. No specific allegation has been attributed against these petitioners. Considering the same, other accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, vide

Patna High Court CR. MISC. No.62785 of 2019(2) dt.15-10-2019 2/2 order dated 11.09.2019 passed in Criminal Misc. No. 43298 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, Ist Class, Bhagalpur, in connection with Sultanganj P. S. Case No. 51 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
