The petitioner seeks regular bail in connection with Economic Offences Police Station Case No. 13 of 2018 (Special Case No. 114 of 2018), registered for the offences punishable under Sections 8/20 (b) (ii) (c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 21.06.2021, passed in Criminal Misc. No. 40149 of 2020. This Court, vide order, dated 18.01.2023, had called for a report as well as explanation from the learned Court below regarding the stage of the case and in pursuance of the said order, an explanation as well as report has been submitted by

Patna High Court CR. MISC. No.66791 of 2022(4) dt.01-02-2023 2/2 learned 09th Additional Sessions Judge, Patna. The explanation submitted by learned 09th Additional Sessions Judge, Patna is accepted. So far as the stage of the trial is concerned, the learned Trial Court has informed that out of ten chargesheeted witnesses, 7/8 have been examined and the estimated time for conclusion of the trial has been given as three months. Learned Counsel for the petitioner submits that the petitioner will be completing five years in custody on 10.10.2023. As such, this case may be kept in the month of October, 2023.

After having heard learned Counsel for the parties and taking into consideration the aforesaid submission and the report of the learned Trial Court, I am not inclined to grant regular bail to the petitioner, at this stage.

This application is, accordingly, dismissed.

However, the petitioner will be at liberty to renew his pryer for bail after six months from today, if the trial is not concluded by that time.
