JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 This is application for grant of anticipatory bail in connection with Bahadurganj P.S. Case No. 63 of 2019 registered for the offence punishable under Sections 354 (D), 504/34 of the Indian Penal Code and Section 67(A) and 67(B) of the Information Technology Act.

As per F.I.R., there is allegation that the photograph of daughter of the petitioner was mad viral. Petitioner is not named in the F.I.R. later on his name is transpired on the basis of statement of victim girl and she also disclosed the name of the petitioner that he along with other accused has taken her photograph and despite of protest made it viral. Submission of learned counsel for the petitioner is that allegation against the petitioner is false and concocted and the photograph, which is made viral, is taken by other accused

Heard learned A.P.P. who opposed the prayer for bail on the ground that the age of the girl is 14 years. Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, petitioner surrender and pray for regular bail before the court below, the same shall be considered on its own merit, without being prejudiced by this order.
