Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner renews his prayer for regular bail in connection with Masaurhi PS case no. 37 of 2020 instituted for the offences punishable under Sections 20/22 of the N.D.P.S. Act, inasmuch as earlier on two occasions, the bail application of the petitioner was dismissed on merit..

This Court, vide order dated 10.11.2023, had called for a report from learned court of Additional Sessions JudgeXVII, Patna regarding the present stage of the trial and the learned trial court, vide letter dated 06.12.2023, has sent a report, from which, it appears that out of total 06 charge-sheeted witnesses, four witnesses are examined and two witnesses are

Patna High Court CR. MISC. No.69381 of 2023(4) dt.02-02-2024 2/2 yet to be examined. The learned trial court has also given the estimated time that trial is likely to be completed with seven months.

Accordingly, I am not inclined to grant privilege of bail to the petitioner at this stage, however, petitioner is at liberty to renew his prayer for bail after 07 months, if the trial is not concluded.

The present petition stands dismissed with aforesaid liberty.
