2. The petitioners seek bail in connection with Giriyak P.S. Case No. 300 of 2025 instituted for the offences under Sections 191(2), 190, 126(2), 303(2), 317(2), 132, 61(2), 111(3), 324(4) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that on 09.07.2025, Mines Inspector along with police party seized three tractors loaded with illegal sand from village

Patna High Court CR. MISC. No.72843 of 2025(2) dt.16-10-2025 2/3 Mohammadpur, and during the operation, 12 persons attempted to snatch the seized tractor, out of whom five accused were arrested on the spot.

4. Learned counsel for the petitioners submitted that petitioners have falsely been implicated in the present case. Learned counsel for the petitioners submitted that general and omnibus allegation has been made against these petitioners. No specific overt act is alleged against these petitioners. It has been submitted on behalf of the petitioners that the petitioners are in custody since 10.07.2025 and have no criminal antecedent. The co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 17.09.2025 passed in Cr. Misc. No. 66201 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court
