JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-12-2022 Mr. Kumar Shanu, learned AC to AG for the State submits that in this case the petitioner has moved directly before this Court for institution of a case against the private respondent nos. 9 to 14. The petitioner has not followed the procedure provided in the judgment of the Hon'ble Apex Court in the case of Priyanka Srivastava & Anr. v. The State of Uttar Pradesh and Ors. reported in (2015)6 SCC 287.

In the aforesaid view of the matter, this application

Patna High Court CR. WJC No.1592 of 2017(2) dt.13-12-2022 2/2 cannot proceed.

At this stage, learned counsel for the petitioner has appeared and submitted that in fact the First Information Report has already been lodged but he had not correctly posed the prayer in the writ application.
