2. The petitioner apprehends his arrest in connection with Dehri (M) P.S. Case No. 107 of 2025, dated 20.06.2025, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 7 litres of illicit country made liquor was recovered from a plastic bag near the village house of the petitioner near pokhar.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The name of petitioner surfaced in the present case on the basis of statement of local co-villagers, who are said to have named this petitioner. Nothing has been recovered from the conscious possession of the petitioner and petitioner has no
Patna High Court CR. MISC. No.66363 of 2025(2) dt.24-09-2025 2/2 concern with the alleged recovery. He fairly submits that petitioner carries one criminal antecedent of similar nature registered in the year 2021 and petitioner is on bail in the said case.
5. Learned Additional Public Prosecutor for the State has opposed the prayer for bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case and the fact that nothing has been recovered from the conscious possession of the petitioner, let the petitioner, above-named, be released on anticipatory bail, in the event of his arrest or surrender before the learned trial Court within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise Court No. 1, Rohtas at Sasaram, in connection with Dehri (M) P.S. Case No. 107 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
