Petitioner is aggrieved by the order dated 15.10.2012, by which, his licence granted for running a P.D.S. shop has been cancelled by the Sub-Divisional officer.

The State has raised a preliminary objection that petitioner has approached this Court without availing the statutory remedy of appeal.

Now, the petitioner wants to prefer appeal.

Accordingly, this writ application stands disposed of

Patna High Court CWJC No.25074 of 2013 dt.26-04-2016 2/2 with a liberty to the petitioner to prefer statutory appeal against the impugned order. If such appeal is preferred by the appellant, let the same be decided on its own merit and in accordance with law.
