JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 32 of 2017, corresponding to Trial No. 256 of 2019, registered for the offences punishable under Sections 341, 325, 354, 504A and 506 of the Indian Penal Code.

As per complaint case there is allegation against the petitioner that when complainant had gone to call of nature he thrashed her and committed rape upon her.

Submission of learned counsel for the petitioner is that complaint case was lodged after one month of occurrence and delay has not been properly explained and as a matter of fact father of complainant had purchased a land from one Md.

Patna High Court CR. MISC. No.61676 of 2019(4) dt.21-11-2019 2/2 Sarfuddin Ansari, from whom the land has been purchased by the petitioner, due to which he has falsely been implicated. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, II Class, Siwan, in connection with Complaint Case No. 32 of 2017, corresponding to Trial No. 256 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
