1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out
Patna High Court CR. MISC. No.77301 of 2024(2) dt.21-11-2024 2/3 of Bahera Police Station Case No. 118 of 2024, dated 29.03.2024, disclosing offences under Sections 341/323/324/504/506/307/447/354/427/379/147 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that the petitioners, along with other accused persons total 11 in numbers, arrived at the door of the informant, armed with various weapons, and assaulted the informant, her husband and her two sons. The accused persons also committed loot and took away cash, ornaments, article, etc.
4. Learned counsel for the petitioners submits that both the parties are co-villagers and the petitioners have falsely been implicated in the present case due to land dispute between the parties. A counter version of this case has also been lodged by the side of the petitioners, having Bahera Police Station Case No. 119 of 2024. He next submits that injury caused to the informant as evident from injury report annexed at Annexure-3, it appears that no serious injury has been found on her person. The injury report of other victims have not been brought on record by the prosecution, as evident from the impugned

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that both the parties are covillagers and case and counter-case is there, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Benipur, in connection with Bahera Police Station Case No. 118 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
