IN THE HIGH COURT OF JUDICATURE AT PATNA
Miscellaneous Appeal No.761 of 2017 ====================================================== Tripurari Sharan Singh and Anr ... ... Appellant/s
Versus
Awanish Kumar Purve and Ors ... ... Respondent/s ====================================================== Appearance :
For the Appellant/s :
Mr.Pranav Kumar, Adv.
For the Respondent/s :
====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 07-11-2022 It is surprising that on the basis of a mentioning slip which does not have signature of any official concerned, this case has come up before the bench. A perusal of this unsigned mentioning slip (Flag-B) shows that it does not match either with the name of the party and/or the learned counsel appearing in the matter or the respondent No. 1 who is supposed to be substituted. It seems, the office does it work in a very casual manner.
As per Flag-A (Remarks Column), the present petition is not maintainable before this Court.
Mr. Pranav Kumar, learned counsel representing the appellants submit that he may be permitted to withdraw this petition with the liberty to prefer appropriate petition before an appropriate Court within a period of two months in view of the report submitted.
Patna High Court MA No.761 of 2017(2) dt.07-11-2022 2/2 Liberty granted.
The petition is accordingly disposed of.
The appropriate Court while considering the limitation shall take into account the fact that the present petition was pending before this Court since 2017. (Rajiv Roy, J) Ravi/AjayU
