2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 420 and 353 of the IPC, section 56 of the Bihar Minerals Rules, 2019 and section 15 of the Environment Protection Act, 1985 and section 21 of the Mines and Minerals (Development And Regulation) Act, 1957.

3. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. Owner of the truck who is named in the FIR, has already been allowed bail by this Court vide paragraph 13 of the bail petition and petitioner is merely driver of the truck which was seized on the spot. Petitioner claims clean antecedent.

4. Considering the aforesaid facts of the case, prayer

Patna High Court CR. MISC. No.74903 of 2023(2) dt.29-11-2023 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Patna City, Patna in Gaurichak Police Station Case No. 385 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
