2. This application has been filed for quashing of the F.I.R. bearing Rajourn P.S. Case No. 394 of 2024 registered under sections 316(2), 318(4) & 3(5) of the Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS).

3. After some arguments, learned counsel for the petitioner is permitted to withdraw this application to move before the Superintendent of Police, Banka with his defence as it has been contended that the F.I.R. was registered on the wrong facts.

4. If such an application is filed, the Superintendent of

Patna High Court CR. MISC. No.72031 of 2024(2) dt.07-10-2024 2/2 Police, Banka will get the case investigated and will consider the defence of the petitioner also during investigation and get the case investigated on those points also.

5. Accordingly, this application is dismissed as withdrawn.
