The petitioner has prayed for bail in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code.

As per allegation in the FIR, while daughter of the informant has gone out of the house for appearing in intermediate examination and she did not return till evening, a search was made by her family members. During search, they came to know that petitioner has abducted her with a view to marry her.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is love affair between the petitioner and daughter

Statement of the victim girl has got recorded in which she has stated that out of her own sweet will, she has eloped from her house and performed marriage with the petitioner. Presently she is living in her matrimonial home. Age of the daughter of the informant has been accessed as 19 years by the lower court. Petitioner is languishing in judicial custody since 14.09.2021 and thereafter remanded in this case on 17.01.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sherghati in connection with Gurua P.S. Case No. 242 of 2019. (Sunil Kumar Panwar, J) sushma/- U
