2. The appellant (Juvenile) had earlier preferred Cr. Appeal (SJ) No. 1755 of 2022 for setting aside the order dated 13.04.2022 passed by the Special Judge (Children Court)-cumA.D.J.-I, Munger in connection with J.J.B. Case No. 80 of 2021 arising out of Sangrampur P.S. Case No. 198 of 2021, which was dismissed by this Court vide order dated 17.11.2022.
3. Submission of the learned counsel for the appellant is that the probation report does not mention anything regarding the appellant as the appellant and his family have left their home and are residing elsewhere. Further submission is that the mother and father of the appellant have already been released on
Patna High Court CR. APP (SJ) No.4591 of 2023(4) dt.22-12-2023 2/2 bail by orders dated 25.02.2022 and 07.04.2023 by different coordinate benches of this Court, as contained in Annexure 4 and
5. It is further submitted that the sister of the appellant undertakes to take care of the appellant and to give proper education to him. The appellant is in custody since 10.08.2021.
4. Considering the submissions made above the appellant, above named, be released on bail, on execution of surety bond by the sister of the appellant giving undertaking that she will keep proper care and upkeep of the appellant and shall fully co-operate in pending inquiry of the trial.
5. The appeal stands allowed.
