ANJANA MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.08.2019 in connection with Excise Case No.875 of 2019 registered for the offence under Section 30(a) of the Bihar Excise Act,2016. It is submitted by the learned counsel for the petitioner that the alleged recoveries were not from the conscious possession of the petitioner but from the open verendah of the joint house of the petitioner. It is further submitted that the petitioner is not having any criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.62969 of 2019(2) dt.14-10-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Jehanabad, in connection with Excise Case No.875 of 2019.
