JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-11-2023 Heard the learned counsel for the petitioner as well as the Mr. J. N. Thakur, learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Pakridayal P.S. Case No. 117 of 2023 registered for the offences punishable under Sections-406, 409, 417, 418, 419, 420, 467 and 468 of the Indian Penal Code.

Allegedly, the petitioner, being a contractual Revenue Karamchari issued illegal rent receipt in the name of one Sukhdeo Upadhyay with respect to the land of Jamabandi No. 890 situated in village-Pakridayal.

Learned counsel for the petitioner has submitted that the petitioner is innocent and he is a person of clean antecedent. As a matter of fact, due to mistake, he issued rent receipt but no benefit was derived to any one from that receipt. It has further been

Patna High Court CR. MISC. No.72109 of 2023(2) dt.07-11-2023 2/2 submitted by learned counsel for the petitioner that the impugned order, itself shows that the said receipt has been declared inactive by the Additional Collector in Jamabandi Cancellation Case No. 116 of 2021-22.

Learned Additional Public Prosecutor opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-8th, Motihari, East Champaran in connection with Pakridayal P.S. Case No. 117 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. Learned court below after accepting the bail bond of the petitioner, shall verify his criminal antecedent and if, it is found that he is involved in any other case except the present one, his bail bond shall liable to be cancelled.
