2. Petitioner seeks bail in a case registered for the offences punishable under Sections 103 , 109 and 3 (5) of BNS and 27 of Arms Act.

3 . As per F.I.R. informant namely , Vinod Singh alleged that on 07.06.2025 , informant was at his field in a madayi , number of persons came and said that they would consume liquor in madayi and upon objection and they opened indiscriminate firing in which one Jay Prakash Kumar died.

4. Learned counsel for the petitioner submits that from bare perusal of F.I.R. it is apparent that petitioner is not assailant of the deceased. Specific accusation of firing is against

Patna High Court CR. MISC. No.67615 of 2025(3) dt.25-11-2025 2/2 other co-accused persons. Petitioner has been made accused in this case only because he is allegedly owner of the Wagon - R vehicle by which the assailant came on the spot. Petitioner is in custody since 22.06.2025 . Similarly situated co-accused person has already been granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 13.10.2025 in Cr. Misc. No. 71339 of 2025 .

5 . The learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail .

6. Considering the aforesaid facts, period of custody and other circumstances of the case , let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM Dehri, District- Rohtas in connection with Akodhigola P.S. Case No. 210 of 2025 .
