ANJANA MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.09.2019 on his surrender in connection with Nagar P.S. Case No. 191 of 2019 registered for the offence under Section 30(a) of the Bihar prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the joint house of the petitioner. It is further submitted that save and except one other case which is not of similar nature, the petitioner has no other criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.62426 of 2019(2) dt.16-10-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned A.D.J.-II-cum-Special Judge (Excise Act), Katihar in connection with Nagar P.S.
