2. The petitioner seeks bail in connection with Nagar P.S. Case No. 713/2024 registered for the offences punishable under Sections 8(C)/ 21(a) of the N.D.P.S. Act.

3. As per the prosecution case, 4.276 grams of smack was recovered from the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that petitioner has two criminal antecedents on which he is on bail and he is in custody since 23.11.2024. The petitioner undertakes to cooperate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner

6. Considering the period of custody of the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court-I, NDPS Act, Muzaffarpur/concerned Court below in connection with Nagar P.S. Case No. 713/2024 subject to condition:- a. The petitioner is directed to mark his attendance in Ahiyapur Police Station on every Sunday of each month. Failure to do so, will result in cancellation of bail bonds of the petitioner.
