The petitioner in the present case is seeking regular bail in connection with Kadwa P.S. Case No.130 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that the petitioner is not named in the FIR and his name has transpired in course of investigation. Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein this petitioner is though not named in the FIR, but his name has transpired in course of investigation and it is the case of

No.62157 of 2019(3) dt.05-12-2019 2/2 the prosecution that a sum of Rs.50 lacs has been looted away by the miscreants and further that the petitioner has got as many as eight cases on his head, all of serious nature of loot and dacoity, there being an apprehension that the petitioner once released on bail will be a threat to the society and his presence may not be procured easily as also that he would influence the witnesses, this Court is not inclined to grant regular bail to the petitioner. This application is dismissed.
