The petitioner seeks bail in connection with Dandkhora P.S. Case No. 42 of 2019 for the offence under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there is no direct allegation against the petitioner rather it is clear from the F.I.R. itself that the informant came to know about the occurrence by the villagers and merely on the basis of suspicion the petitioner has been implicated in this case. Learned A.P.P. for the State has opposed the prayer

Patna High Court CR. MISC. No.61476 of 2019(3) dt.15-11-2019 2/2 for bail and submitted that the petitioner is a husband of the deceased and there is allegation of torture and dowry demand against him. Moreover, the witnesses have supported the prosecution version which is evident from para-10, 11, 19, 20 and 39 of the case diary. Considering the facts and circumstances of the case, this Court is not inclined to release the petitioner on regular bail. According, the prayer for grant of regular bail is rejected.
