1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in connection with Daraunda P.S. Case no.312 of 2025 registered under sections 126(2), 115(2), 109(1), 352, 351(1) and 3(5) of the B.N.S, 2023 and Section 27 of the Arms Act.

3. The allegations in the F.I.R is that as many as 10 persons including this petitioner came variously armed and indulged in assault. It is further alleged that accused Sahnawaj Khan had fired indiscriminately upon the son of the informant due to which his son sustained bullet injury on his stomach and arms.

4. Learned counsel for the petitioner submits that it would be apparent from the F.I.R itself that the petitioner has been made accused in this case as being a member of mob. The

Patna High Court CR. MISC. No.68566 of 2025(2) dt.26-09-2025 2/2 specific allegation of opening firing is attributed to co-accused Sahnawaj Khan. He further submits that it is only account of some political rivalry that the petitioner has been made an accused in this case. The petitioner undertakes to co-operate in case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the aforesaid facts and also considering that there is general and omnibus allegation levelled against him and specific allegation of open firing being upon co-accused Sahnawaj khan, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Daraunda P.S. Case no.312 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
