2. The petitioner apprehends his arrest in Parnadabar P.S. Case No. 193 of 2023 registered for the offences punishable under Sections 30(c), 41 of the Excise Act pending in the Court of learned Exclusive Special Excise Judge 1st, Nawada.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the

Patna High Court CR. MISC. No.69947 of 2023(3) dt.30-01-2024 2/2 order, preferably, on the same day, without being prejudiced by this order, considering the fact that one of the co-accused persons has been granted anticipatory bail by a Co-ordinate Bench of this Court.
