Petitioners apprehend their arrest in Morkahi P.S. Case No.123 of 2018 registered under Sections 420, 406, 468 and 120B of the Indian Penal Code.

The informant filed complaint case on the basis of which the present case was registered. The informant alleged that she purchased a small piece of land from Abdul Jabbar and when the informant went to her purchased land to construct house, all the accused persons forbade her not to construct house and they refused to return money.

No.65850 of 2019(2) dt.22-10-2019 2/2 Learned counsel for the petitioners submits that petitioner no.1 purchased the land from Bibi Madina and he sold the land to the informant. There is no defect in transfer of title to the informant. No case is made out under section 420, 406, 468 and 120B of the I.P.C.

Having considered the facts and the nature of allegation made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Morkahi P.S. Case No.123 of 2018 (G.R. No.2745 of 2018), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
