JUSTICE SANJAY PRIYA ORAL ORDER 06-09-2017 This petition has been filed to modify the order dated 15-05-2017 passed in Cr. Misc. No. 16983 of 2017. It has been submitted that the petitioners were granted anticipatory bail by the aforesaid order but they could not surrender in the court below within stipulated time because the case record of this case was transferred to the court of learned Additional District & Sessions Judge-I, Motihari, East Champaran from the court of Sri S.K. Mishra, Judicial Magistrate-Ist Class, Sikarahana, Motihari in the light of new amendment in SC/ST Act and therefore, they could not furnish the bail bonds within stipulated time. Hence a prayer has been made to extend the time for surrender of the petitioners.

In view of the aforesaid submission, this modification application is allowed to the extent that the time for surrender of

Patna High Court Cr.Misc. No.43289 of 2017 (2) dt.06-09-2017 the petitioners in the court below is extended for further four weeks from the date of receipt of the order. If the petitioners surrender in the court below, in that event, they will be released on same terms and conditions as mentioned in the order dated 15-052017 passed in Cr. Misc. No. 16983 of 2017 to the satisfaction of ADJ-Ist, Motihari, East Champaran.

It is made clear that no further extension of time will be granted.

This modification application is, accordingly, disposed off.
