2. The petitioner seeks bail in connection with Hattha P.S. Case No. 39 of 2024 dated 31.05.2024 registered for the offences punishable under Sections 356 and 379 read with Section 34 of the I.P.C.

3. As per the prosecution case, three unknown miscreants are alleged to have surrounded the motorcycle of the informant and looted Rs. 1,71,420/-, Tab, Sim Card, A/C Opening Form, Marfo (Thumb Print) and purse containing Aadhar Card, Pan Card, ATM Card and R.C. Card of the vehicle.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.72090 of 2024(3) dt.25-10-2024 2/3 that the petitioner is innocent and has falsely been implicated in this case. F.I.R. is registered against unknown. He is not named in the F.I.R. He has not been put on T.I. Parade. He has been remanded in the present case from Hattha P.S. Case No. 40 of 2024. One old wallet account opening form, R.C. Book etc., were recovered from the house of the petitioner but it is strange as to why any criminal will keep such stolen articles in his house which has no use at all. The other co-accused Chandan Ram has already been granted bail by a Bench of this Court vide Cr. Misc. No. 70790 of 2024 under order dated 07.10.2024. The petitioner has one criminal antecedent in which he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 16.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IXth, Muzaffarpur, East, in connection with Hattha P.S. Case No. 39 of 2024.
