The petitioner is languishing in custody since 29.06.2019 in a case registered for the offence punishable under Section 395 of the Indian Penal Code.
It is alleged that the informant's cash amount of Rs.3,28,000/-, one locket and a mobile phone were snatched by three unknown motorcycle borne miscreants, leading to registration of FIR against unknown. The name of the petitioner sprang up during investigation.
It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present case. Moreover, neither any recovery has been made from the conscious physical possession of the petitioner nor the

It is further submitted that the petitioner is accused in one other case. Learned APP for the State submits that the name of the petitioner sprang up during investigation. Considering the fact that neither any recovery has been made from the conscious physical possession of the petitioner nor the petitioner has been put on the Test Identification Parade and the investigation already being concluded, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara, in connection with Piro P.S. Case No. 177 of 2019, G. R. No. 2828 of 2019.
