JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-10-2019 The petitioner apprehends his arrest in connection with Tatarpur P. S. Case No. 31 of 2019 registered under Sections 419 and 420 of the Indian Penal Code and 10 of the Bihar School Examination Conduct Rule, 1981.

Allegation against the petitioner is that petitioner was examinee of Psychology but instead of appearing in the examination himself, he paid a sum of Rs. 8,000/- to impersonator Alok Kumar, who sat in the examination instead of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent having no criminal antecedent. He further submits that petitioner is a young person studying in graduation and was having good character till institution of the present case.

Patna High Court CR. MISC. No.61567 of 2019(2) dt.15-10-2019 2/2 Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent, as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJMVII, Bhagalpur in connection with Tatarpur P.S.Case No. 31 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
