2. In the present case, the petitioners seek bail in connection with Warisnagar P.S. Case No. 128 of 2025
2/4 registered for the alleged offences under Section 30(a) of Bihar Prohibition and Excise Act.
3. As per prosecution case, police received information about the petitioners and other co-accused persons bringing a huge consignment of illicit liquor and keeping it in the hut of petitioner Navjeev Singh @ Munna Singh near the hospital. When the police party reached the spot 5-6 persons fled away on seeing the police party. On search of the hut of petitioner Navjeev Singh @ Munna Singh, recovery of 1300.5 litres of foreign liquor was made.
4. Learned counsel for the petitioners submits that the petitioner are innocent and have been falsely implicated in this case. The petitioners have not been apprehended from the spot and nothing incriminating has been recovered from their conscious possession. The petitioners have nothing to do with the place from where the recovery has been made. Recovery has been made from open hut though the land belongs to petitioner Navjeev Singh @ Munna Singh but petitioners have no concern with the hut or the seized liquor. The petitioners have no knowledge of storage of the liquor in the hut. Petitioner Trilok Chaudhary has antecedent of one case whereas petitioner Navjeev Singh @ Munna Singh has no criminal antecedent. The
3/4 petitioners are in custody since 06.08.2025.
5. Learned APP opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that the petitioners were not apprehended from the spot and recovery from an open place, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Exclusive Excise Judge II, Samastipur/concerned Court in connection with Warisnagar P.S. Case No. 128 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the
4/4 petitioners will be liable to be cancelled by the court concerned.
