====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 31-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Wazirganj P.S. Case No.26 of 2023, registered for the offences punishable under Section 394 of the Indian Penal Code.

3. As per the prosecution case, the informant is said to have been assaulted by fists and slaps and his motorcycle was looted by three unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The name of petitioner transpired in this case only on the basis of confessional statement of co-accused person and no T.I.P. has been conducted. He further submits that although there is four criminal antecedents of petitioner but the same relates to

Patna High Court CR. MISC. No.69651 of 2023(3) dt.31-01-2024 2/2 Excise Act and petitioner is in custody since 14.06.2023. Learned counsel submits that similarly situated co-accused person namely Rahul Rajvanshi has already been granted bail by the Co-ordinate Bench of this Court vide order dated 05.09.2023 passed in Cr. Misc. No.57629 of 2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Gaya in connection with Wazirganj P.S. Case No.26 of 2023.
