2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399, 402, 414, 120(B) of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act.
3. As per allegation in the FIR, some accused persons were hatching a conspiracy for bank robbery and in the meantime acting on a tip off police party reached there and apprehended one accused, namely, Kaushal Kumar Shyam. On search, one country made loaded katta and one live cartridge were recovered and he also disclosed other accused persons including the name of the petitioner as their associates.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner
Patna High Court CR. MISC. No.73222 of 2024(2) dt.18-10-2024 2/2 was neither put on TIP nor any thing was recovered from his conscious possession. One day prior to this case, petitioner was already arrested in another case and sent for judicial custody and in respect of that case, petitioner has already been enlarged on bail vide order dated 30.07.2024 passed in Cri. Misc. No. 51604 of 2024 by another co-ordinate Bench of this Court. Similarly situated other accused person has also been enlarged on bail by court below. Petitioner is languishing in judicial custody since 15.6.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Gangabridge P.S. Case No. 68 of 2024.
