The petitioner is languishing in custody since 21.06.2019 in a case registered for the offence punishable under Section 3 of the the Railways Property (Unlawful Possession) Act, 1966.

Accusation is of committing robbery in a train. It is submitted by learned counsel for the petitioner that there is no recovery from the conscious physical possession of the petitioner and the investigation has already been concluded. It is further submitted that though the petitioner is accused in two other cases of similar nature, apart from the present case, but in both the cases, he is on bail.

Patna High Court CR. MISC. No.62009 of 2019(2) dt.23-10-2019 2/2 Learned APP for the State submits that the petitioner appears to be a habitual offender as he is accused in two other cases of similar nature.

Considering the fact that there is no recovery from the conscious physical possession of the petitioner and the investigation already being concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai, in connection with Garhara RPF Case No.9 of 2017.
