2. The petitioner seeks bail in connection with Buxar Industrial Area P.S. Case No. 193 of 2023 registered for the offence under Sections 20(b)(ii)(b)/29 of the N.D.P.S. Act.

3. As per the prosecution case, the dispute is whether the recovery of ganja from the petitioner is 18.94g or 18.94kg. Initially, the police said that 18.94g ganja was recovered subsequently an application was filed that recovery of ganja from the petitioner is 18.94kg.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 25.7.2023 and he has clean antecedent.

5. The benefit of mistake committed by the police given to the petitioner, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District Judge-cum-Special Court, N.D.P.S. Act, Buxar in connection with Buxar Industrial Area P.S. Case No. 193 of 2023.

7. The petitioner will visit Buxar Industrial Area Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
