The petitioner seeks bail in a case registered under Sections 323, 504, 506, 307, 353, 386/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner were demanding ransom from the shopkeepers with dire consequences by firing and exploding bomb. It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.7.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation in

Patna High Court CR. MISC. No.67387 of 2019(2) dt.23-10-2019 2/2 respect of Section 386 of I.P.C. is denied by the petitioner. The nature of injury is said to be simple. Hence, no offence under Section 307 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut (Gokulpur O.P.) P.S. case No.215 of 2019.
