Patna High Court CWJC No.19385 of 2019(2) dt.24-09-2019 2/2 conclude the proceedings of Encroachment Case No. 3 of 201617 which is pending before him since a long time and despite the directions issued by the District Magistrate, East Champaran, Motihari, passed on 16.11.2017, no action has been taken.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with a direction to the Circle Officer, Raxaul, East Champaran to conclude the aforesaid Encroachment Case No. 3 of 2016-17 by passing a final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after considering the objections of the encroachers, if any, within a period of 90 days of receipt/production of a copy of this order and thereafter, remove the encroachment in question, if so found.
