2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Complaint Case No.3569 of 2019 instituted for the offence under Sections 323, 341, 379, 497, 498(A) and 504/34 of the Indian Penal Code.
3. The case of the complainant is that she was married to one Shardanand Sahni according to Hindu rites and rituals. It is further alleged that the petitioners who are the in-laws of the complainant, they along with the husband of the informant subjected the informant to cruelty on account of non-fulfillment of dowry demand.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.70370 of 2024(2) dt.25-10-2024 2/2 petitioners has submitted that the petitioners are innocent and have been falsely implicated in this case. On perusal of the complaint petition, it is clear that the main allegation is against the husband. The petitioners are in-laws having clean antecedent.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioners.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Complaint Case No.3569 of 2019, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
