2. The petitioner seeks regular bail in connection with G.R.P. Patna (Gulzarbagh) P.S. Case No. 115 of 2023 registered on 27.02.2023 lodged under Sections 393/307/326 I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against 3 unknown accused persons including the petitioner.

4. Counsel for the petitioner submits that in the present case, he has been remanded from the another case and his name has been inserted in this case by the confessional statement of petitioner himself.

5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 03.04.2023 having ten criminal case pending

Patna High Court CR. MISC. No.68853 of 2023(5) dt.29-02-2024 2/3 against him. He further submits that nothing incriminating has been recovered from the possession of the petitioner. Moreover, no TIP has been conducted.

6. Counsel further submits that one of the co-accused has been granted bail by co-ordinate Bench of this Court vide order dated 22.09.2023 passed in Cr. Misc. No. 62927 of 2023.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge if not framed yet and on being satisfied by the trial Court that he is not absconding in any of the criminal cases pending against him which is mentioned below and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with G.R.P. Patna (Gulzarbagh) P.S. Case No. 115 of 2023 subject to thelaid down under Section 437 (3) of the Cr.P.C.
