2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 103 (1) , 238 and 3 (5) of the BNS.
3 . As per F.I.R., informant namely, Bindeshwar Sardar suspects that these petitioners along with other coaccused persons killed the daughter of informant due to old enmity .
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.66989 of 2025(3) dt.07-11-2025 2/3 informant is not an eye witness to the alleged occurrence . Only suspicion has been raised against these petitioners because of old enmity . Admittedly, petitioners are agnates of husband of deceased and they are separate in mess and property and have got no concern with the deceased and her family members. During course of investigation , police collected data of CDR of the mobile phone of deceased and found that deceased was in contact with strangers till the mid night of the alleged occurrence and it has also came to light that on the same night, the mobile phone of deceased had gone traceless which also indicates the involvement of strangers in the aforesaid occurrence . Except suspicion , there is no other material on record to substantiate the complicity of these petitioners in the alleged occurrence . Petitioners claim clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, general and omnibus allegation , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like
