The petitioner seeks pre-arrest bail in connection with Rajpur P.S. Case No. 155 of 2019, pending in the Court of the Chief Judicial Magistrate, Buxar, registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is of recovery of country made rifle from the house of the petitioner.

Submission is that in fact the alleged seized country made rifle was recovered from the joint house and at the time of recovery the petitioner was not at the house. Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and
