This application, for grant of anticipatory bail, arises out of Sahebganj P.S. Case No. 246/16, disclosing offences under Sections 363, 366(A) of the Indian Penal Code. Learned counsel for the petitioner submits that victim girl has solemnized marriage with the boy with whom she had eloped. The petitioner was named in the F.I.R. as being the friend of the alleged victim.
According to the learned counsel for the petitioner, entire prosecution case stands falsified in view of subsequent development.
I find force in the submission of learned counsel for the petitioner. This application is, accordingly allowed. Let the
Patna High Court Cr.Misc. No.43270 of 2017 (2) dt.21-09-2017 2/2 petitioner above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Muzaffarpur (West), in connection with Sahebganj P.S. Case No. 246/2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
