The petitioner has renewed his prayer for grant of bail in a case registered under sections 420 and 406 of the Indian Penal Code.

The earlier application for bail of the petitioner was rejected vide order dated 10.5.2022 passed in Cr. Misc. no.57168 of 2021.

As per the prosecution case, it is stated by the informant who is a District Co-ordinator of Sanjivni Vikas Foundation and whose N.G.O. provides banking facilities in Urban and Rural areas that the accused persons including Amod

Patna High Court CR. MISC. No.70177 of 2022(2) dt.14-12-2022 2/3 Kumar Mishra as also the Assistant of the said Co-ordinator ie the petitioner herein cheated various account holders. Complaints were made by the customers in the office of the informant and the F.I.R. registered.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 10.5.2022 passed in Cr. Misc. no.57168 of 2021, giving liberty to the petitioner to renew his prayer for bail after six months. It is further submitted that the main allegation is against co-accused Amod Kumar Mishra who has himself been enlarged on bail vide order dated 27.7.2021 passed in B.P. no.2402 of 2021. The petitioner has no criminal antecedent and is in custody since 15.7.2021. Chargesheet has been submitted. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody for about 1 year 5 months together with the liberty granted in the aforesaid order of rejection dated 10.5.2022, the Court directs the petitioner to be enlarged on bail in connection with Bettiah Muffasil (Banuchhapar) P.S. Case no.450 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the
