JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 2120 of 2010, disclosing offences under Sections 323, 504, 498A, 379 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. As per F.I.R. there is allegation of demand of Rs.50,000/- and for that, subjecting the complainant to cruelty. It is also alleged that he tried to kill her also. Submission of learned counsel for the petitioner is that the allegation is false and concocted. Earlier also such type of case has been lodged by the complainant. As a matter of fact, she is not ready to reside with the petitioner. On the other hand, petitioner is still ready to keep her with dignity and care.

Having heard both sides, in view of the facts, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on provisional bail to the satisfaction of the learned court below. During that period, the court below shall issue a notice to the opposite party no.2. Once she appeared and she is ready to reside with the petitioner, and petitioner is ready to keep her with dignity and care, the learned Court below shall watch their conduct for a further period of six months. Once, the court below is satisfied with the conduct of both the parties, especially, the conduct of the petitioner, the bail bond of the petitioner shall be confirmed. It is also made clear that once the opposite party no.2 appears and she is not ready to reside with the petitioner, in that, condition also, the bail bonds of the petitioner shall be confirmed.
