The petitioner seeks bail in a case registered under Sections 457 and 380 of the Indian Penal Code. Jewellery worth Rs. 8 lacs and cash of Rs.45000/- are said to have been stolen from the house of the informant by some unknown miscreants.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case merely on suspicion. He is not named in the F.I.R. No incriminating article has been recovered from the conscious physical possession of the petitioner. There is nothing cogent on record

Patna High Court CR. MISC. No.61483 of 2019(3) dt.27-11-2019 2/2 indicating the complicity of the petitioner in the occurrence barring his confessional statement which has no evidentiary value in the eye of law. Petitioner has been languishing in custody since 04.04.2019.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XII, Patna in connection with Patliputra P.S.
