Mr. Rajendra Singh Shastri, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 17-09-2025 Heard Mr. Sanjay Kumar S.K., learned counsel for the petitioners and Mr. Rajendra Singh Shastri, learned APP for the State.

2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 115(2), 126(2), 118(1), 117(2), 109, 351(2), and 3(5) of the Bhartiya Nyay Sanhita, 2023.

3. The case of the prosecution is that the petitioners along with others assaulted the brother of the informant indiscriminately.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned counsel for the petitioners has submitted that the

Patna High Court CR. MISC. No.67267 of 2025(2) dt.17-09-2025 2/2 nature of allegation is general and omnibus. The brother of the informant has received three injuries. Injury no. 2 which is fracture bilateral temporal-parietal bone and the same is grievous in nature. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 18.06.2025.

5. Learned APP appearing for the State has conceded that though the injury of the injured is grievous in nature yet the nature of allegation is general and omnibus.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sahebganj P.S. Case No. 291 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-XVII, Muzaffarpur.
