Ms. Gulnar Begum, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-01-2023 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are in judicial custody in a case registered for the offences punishable under Sections 36(a), (c) (d) of the Bihar Prohibition & Excise Act, 2018. Allegedly, it is a case of recovery of illicit liquor from a government land.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that they have no concern with the seized liquor

No.69508 of 2022(2) dt.06-01-2023 2/2 and no any incriminating article has been recovered from the conscious possession of the petitioners as well as petitioners are in judicial custody and the name of the petitioners came into light on the basis of statement of the local villagers and petitioners have clean antecedent.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-II-cum-Additional District & Sessions Judge, Rohtas at Sasaram in connection with Nokha P.S. Case No. 330 of 2022.
