The petitioner is languishing in custody since 27.6.2019 in a case registered for the offences punishable under Sections 356 and 379 of the I.P.C.
The prosecution case is that while the informant along with his wife, was coming after withdrawing Rupees One Lac from the SBI Main branch, Araria, the two motorcycle borne miscreants robbed the purse of the informant's wife containing money. The name of the petitioner sprang up during investigation.
It is submitted by learned counsel for the petitioner that till date the petitioner has not been put on Test Identification Parade. Though the petitioner is accused in three other cases but he is on bail in those cases.
Patna High Court CR. MISC. No.62360 of 2019(2) dt.23-10-2019 2/2 Learned APP submits that the petitioner's name sprang up during investigation.
Considering the fact that the investigation has already concluded, no recovery has been made from the petitioner and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Forbesganj P.S. Case No.380 of 2019.
